Terms and Conditions

Definitions
We, us, our mean VA Health Warriors.

You and your mean the purchaser of services and course materials from VA Health Warriors.

This is a contract between us and you.

This document outlines the framework for our services at VA Health Warriors. Terms for 121 and group programmes differ slightly, as stated in the individual sections of this document. For 121 programmes, terms will be discussed with you during the first session of our work together.

Please ask if there is anything you would like clarified and sign the contract at the bottom of the document.

General Terms
When you purchase services and courses from us, we grant you a licence (which is limited, revocable, non-exclusive, non-transferable) to listen to, download or stream such content to your computer and/or other device(s) solely for your personal, non-commercial use. You agree to not otherwise copy, reproduce, distribute or use the content other than as set out in this contract. You must not sell, transfer, lease, modify, distribute or publicly perform the content in any manner and you must not exploit it commercially. You agree to not tamper with the content or create any derivative works therefrom. We may terminate your license to use any purchased products if you breach this contract.

VA Health Warriors reserves the right to change these terms and conditions at any time without prior notice. In the event that any changes are made, the revised terms and conditions shall be posted on this website immediately.

If any of the Terms given in this document are found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the Terms which will continue in full force and effect.

Trademarks
Trademarks used on the Website belong to their respective owners. You must not use any trademark displayed on the Website without the express written permission of us or the third-party owner.

Payment
All services are to be paid upfront before the start of your programme. All goods sold by us are charged in GDP (British pounds). 

Refunds
If you are not totally happy with KickStart after the first 7 days of you making payment, we will refund your money. Requests for refunds must be made in writing to us within the defined refund period as stated above, at support@vahealthwarriors.com.

The caveat to this is you must demonstrate that you have participated in the programme by accessing course content and joining and participating in the Facebook community before requesting a cancellation of your programme membership and refund. We may request the submission of completed worksheets, activities and exercises in considering your refund request.

A change of mind does not constitute a valid reason for cancellation and request for refund. In considering your refund we may also charge an admin fee at our discretion.

If you receive your money back, you are required to delete every copy of the product that you have downloaded as well as any copies you have placed on other devices or media.

If you are entitled to a refund, we will refund your money within two weeks of notice to us and the entitlement arising. Your refund will be paid in the currency in which it was received by us. If you paid in a currency other than British pounds, you are liable for the costs of exchange.

Working hours
Our online hours are 8am - 8pm Monday to Friday and 9am - 5pm Saturdays. We respond to messages as soon as possible within these times and aim to reply within 24 hours. We do not work Sundays or Bank Holidays.

Data Protection and Confidentiality
We work as a team to support you with your health goals. Information about any symptoms and conditions will be discussed between us only so that we can provide you with a co-ordinated plan. If you are not comfortable with this, please email kali@vahealthwarriors.com.

The fact that you are a client of VA Health Warriors is confidential, as well as what you discuss in your sessions. There are, however, some limits and exceptions to confidentiality.

If we have serious concerns about your safety or the safety of another person normal confidentiality may be lifted. You will be asked to provide your GP’s contact details as someone we may contact if necessary. VA Health Warriors keeps a record of your name, contact details and dates and times of appointments on a password-protected database. We are required to keep brief notes about the focus of your work. These are kept securely and are password protected. Any reports produced by VA Health Warriors to evaluate the service contain anonymised data and will not contain any identifying information of clients.

Information about you will be stored in relation to Data Protection Law. Once your agreement has ended, this information will be stored for 12 months and then it will be deleted (unless stated otherwise). We will not share your information with any other person.

Online Personal Training
We recommend you seek professional medical advice prior to starting any of our programmes. Even in healthy individuals, there is some risk to an exercise programme. It is your responsibility to use your personal judgement and take into consideration any medical advice before engaging with any of the content provided by us. You are responsible for informing us of any health issues or medical conditions before undertaking online personal training. If anything changes in your health during the course of your work with us, it is your responsibility to let us know immediately so we can take this into consideration. 

Where we provide you with an individualised online personal training programme, the information contained therein should not be considered as a comprehensive health or exercise programme. Accordingly any actions that you take in relation to a programme should not be pursued regardless or to the exclusion of other information, opinions or judgments that are available to you.

Any individualised programme is designed according to the information you provide and you are responsible for the accuracy of this. Before taking any action in relation to the programme, you should take into account any other factors of which you are or should be aware.

The information given in any personal training programme may relate to certain contexts and might not be appropriate in other contexts. It is your responsibility to ensure you do not use the information provided by us in the wrong context.

Any information we provide that does not directly form part of your programme, eg. websites, e-books, videos, social media (such as Facebook, Instagram or YouTube) or otherwise, is only provided for general information purposes.

121 PROGRAMMES
The terms in this section apply to the KickStart 121, Ultimate Fat Loss and Recharge Your Batteries programmes.

Payments 
You will be invoiced for payment before your first phone consultation and this should be paid to confirm the appointment. Payments can be made by bank transfer or PayPal.

Cancellations/Missed Appointments 
If you need to cancel an appointment please let us know with at least 48 hours notice. You can do this via Whatsapp or email. You are required to pay for sessions which are missed or cancelled with less than 48 hours notice.

It is your responsibility to have a working internet connection for all Zoom, Skype and FaceTime sessions. You will be charged for scheduled sessions if we are waiting for your call, but you are unable to connect online. We will call you on a UK landline or mobile number for any phone sessions arranged.

Nutritional Therapy
The following terms apply to the Ultimate Fat Loss and Recharge your Batteries programmes.

Kali Harmen, Registered Nutritional Therapist, works within the British Association of Applied Nutrition & Nutritional Therapy’s ethical framework. 

This document only covers the practice of Nutritional Therapy within your consultation, and Kali Harmen will make it clear if she intends to step outside this boundary.

Nutritional Therapy is the application of nutrition science in the promotion of health, peak performance and individual care. Nutritional Therapy practitioners use a wide range of tools to assess and identify potential nutritional imbalances and understand how these may contribute to an individual's symptoms and health concerns. This approach allows them to work with individuals to address nutritional balance and help support the body towards maintaining health.

Nutritional Therapy is recognised as a complementary medicine and is relevant for individuals with chronic conditions, as well as those looking for support to enhance their health and wellbeing. Practitioners consider each individual to be unique and recommend personalised nutrition and lifestyle programmes rather than a 'one size fits all’ approach. Practitioners never recommend nutritional therapy as a replacement for medical advice and always refer any client with 'red flag' signs or symptoms to their medical professional. They will also frequently work alongside a medical professional and will communicate with other healthcare professionals involved in the client's care to explain any nutritional therapy programme that has been provided. 

Please note the following:

  • The degree of benefit obtainable from Nutritional Therapy may vary between clients with similar health problems and following a similar Nutritional Therapy programme. 
  • Nutritional advice will be tailored to support health conditions and/or health concerns identified and agreed between both parties. 
  • Nutritional Therapists are not permitted to diagnose or claim to treat medical conditions.
  • Nutritional advice is not a substitute for professional medical advice and/or treatment. 
  • Nutritional Therapists may recommend food supplements and/or functional testing as part of your Nutritional Therapy programme and may receive a commission on these products or services.
  • Standards of professional practice in Nutritional Therapy are governed by the CNHC Code of Conduct. 

By undertaking Nutritional Therapy, you agree to the following:

  • I am responsible for contacting my GP about any health concerns. 
  • I give permission for you to contact my GP regarding any agreed aspects of my case. 
  • If I am receiving treatment from my GP, or any other medical provider, I should tell him/her about any nutritional strategy provided by my Nutritional Therapist. This is necessary because of any possible reaction between medication and the nutritional programme. 
  • It is important that I tell my Nutritional Therapist about any medical diagnosis, medication, herbal medicine, or food supplements, I am taking as this may affect the nutritional programme. 
  • If I am unclear about the agreed Nutritional Therapy programme/food supplement doses/time period, I should contact my Nutritional Therapist promptly for clarification.
  • I must contact my Nutritional Therapist should I wish to continue any specified supplement programme for longer than the original agreed period, to avoid any potential adverse reactions.
  • Recording consultations using any form of electronic media is not allowed without the written permission of both me and my Nutritional Therapist.

GROUP PROGRAMMES
If you are doing one of our Group programmes, engagement with the Facebook group is an integral part of your course. Please read the announcements section on the Facebook page and make sure you comply with the rules given.

Communication and Commitment
We can best help you with this process if you keep us fully informed of any issues that arise for you, and if you have any questions or concerns please don’t hesitate to voice them. If you are having a problem with our service, please raise it with us and we will support you in finding a resolution.

While we can give you the tools and encouragement to reach your goals, ultimately you will need to assume responsibility for making the required changes. It’s difficult to give guarantees in this industry because it really comes down to you - what you put into the programme is exactly what you will get out of it. However, if you are fully committed, following all the strategies, techniques and guidelines we suggest, then we can guarantee you will finish the programme with:

  • The information you need to avoid the guesswork when it comes to losing weight and healthy eating.
  • A set of tools you can use for continued weight loss and maintenance.
  • An understanding of why weight loss is affected by more than what you eat.
  • The ability to apply goal setting and habit forming techniques to any area of your life.

One thing we can guarantee is that we’ll have your back every step of the way and will celebrate each & every one of your successes!
